Terms of Service

DFW Solar Services LLC

These Terms of Service govern all services provided by DFW Solar Services LLC (“Company”). By scheduling service, approving an estimate, or allowing work to begin, the customer (“Client”) agrees to the following terms.

1. Scope of Services

DFW Solar Services LLC provides solar maintenance, inspection, diagnostic, and repair services including but not limited to:

  • Solar panel cleaning
  • System diagnostics and troubleshooting
  • Solar system inspections and pre-purchase inspections
  • Critter guard installation
  • Panel removal and reinstallation
  • Inverter replacement and electrical troubleshooting
  • General solar system maintenance and repairs

Services are performed based on visible conditions and information available at the time of service. Hidden defects or concealed conditions may exist that cannot be reasonably detected during inspection or service.

2. Pre-Existing Conditions Disclaimer

Solar systems, roofing systems, electrical systems, and mounting structures may contain pre-existing damage, installation deficiencies, or wear that are not visible prior to service.

DFW Solar Services LLC is not responsible for damage resulting from pre-existing conditions, including but not limited to:

  • Roof leaks or roof deterioration
  • Improper solar installation by previous contractors
  • Damaged or defective panels
  • Microcracks in solar modules
  • Electrical faults or wiring issues
  • Mounting or structural deficiencies
  • Equipment failure unrelated to service performed

If potential issues are observed, they may be documented and communicated to the Client.

3. Roof Access & Roof Condition

Solar services require technicians to access the roof and work around solar equipment.

By authorizing service, the Client acknowledges that:

  • The roof structure is safe and suitable for technician access
  • Normal technician foot traffic may occur during service

DFW Solar Services LLC is not responsible for roof damage or leaks caused by:

  • Pre-existing roof conditions
  • Aging roofing materials
  • Improperly installed solar mounting systems
  • Hidden structural defects

If unsafe conditions are discovered, the Company may postpone or decline service.

4. Solar Panel Cleaning Disclaimer

Solar panels are constructed of tempered glass and may contain microfractures, internal cell defects, or manufacturing imperfections that are not visible prior to cleaning.

DFW Solar Services LLC is not liable for panel damage resulting from:

  • Pre-existing microcracks or internal defects
  • Manufacturing defects
  • Thermal stress or expansion
  • Weak or compromised glass

Cleaning services follow industry-standard soft washing practices designed to minimize risk.

5. Use of Subcontractors

DFW Solar Services LLC may utilize qualified subcontractors, technicians, or third-party service providers to perform certain services.

These parties operate as independent contractors.

While the Company works with qualified professionals, DFW Solar Services LLC is not liable for delays, damages, or losses caused by subcontractors outside the Company’s direct control.

6. Energy Production Disclaimer

Solar maintenance or repair services may improve system performance, however DFW Solar Services LLC does not guarantee energy production, savings, or performance improvements.

Solar output depends on multiple external factors including:

  • Weather conditions
  • Panel degradation
  • Equipment condition
  • System design
  • Utility grid conditions
  • Shading and environmental factors

7. Warranty Limitations

DFW Solar Services LLC does not manufacture solar equipment and does not provide warranties for:

  • Solar panels
  • Inverters
  • Microinverters or optimizers
  • Electrical components
  • Mounting systems

Manufacturer warranties remain the responsibility of the original equipment manufacturer.

Any workmanship performed by DFW Solar Services LLC may include a limited workmanship warranty only if explicitly stated in writing on the invoice or service agreement.

Unless otherwise stated in writing:

  • No additional warranties are expressed or implied
  • The Company disclaims implied warranties including merchantability and fitness for a particular purpose

8. Limitation of Liability

To the maximum extent permitted by law, DFW Solar Services LLC shall not be liable for indirect, incidental, special, or consequential damages, including but not limited to:

  • Loss of energy production
  • Loss of utility savings
  • Business interruption
  • System downtime
  • Loss of revenue

Total liability for any claim related to services provided shall not exceed the amount paid by the Client for the specific service performed.

9. Damage Claim Time Limit

Any claims related to damage allegedly caused by services performed by DFW Solar Services LLC must be reported in writing within 72 hours of service completion.

Failure to notify the Company within this timeframe constitutes acceptance of the work performed and a waiver of any claims related to that service.

10. Indemnification

The Client agrees to indemnify, defend, and hold harmless DFW Solar Services LLC, its owners, employees, contractors, and subcontractors from any claims, damages, losses, or expenses arising from:

  • Pre-existing system defects
  • Improper installation by other contractors
  • Structural or roof-related issues
  • Client-provided equipment or instructions
  • Conditions outside the Company’s control

This includes legal fees and costs arising from third-party claims.

11. Photo Documentation

DFW Solar Services LLC may take photographs or video during service for purposes including:

  • Service documentation
  • Diagnostic analysis
  • Work verification
  • Internal records

These materials remain the property of the Company and may be used for documentation and reporting purposes.

12. Estimates & Additional Work

Quotes and estimates are based on visible conditions and information provided by the Client.

Additional issues discovered during service may require:

  • Additional labor
  • Replacement parts
  • Additional service visits

The Client will be notified before additional work is performed whenever reasonably possible.

13. Weather & Scheduling

Solar service work depends on safe working conditions.

Appointments may be rescheduled due to:

  • Weather conditions
  • Rain or lightning
  • High winds
  • Unsafe roof conditions
  • Equipment issues

14. Payment Terms

Payment terms are listed on the invoice or estimate.

Payment may be required:

  • At booking
  • Upon completion of service
  • Within the timeframe specified on the invoice

Late payments may incur additional fees.

Alternative payment methods such as cash, Zelle, or Venmo may be accepted to avoid credit card processing fees.

15. Cancellation Policy

Clients should provide at least 24 hours notice to cancel or reschedule appointments.

Failure to provide adequate notice may result in a dispatch or service fee.

16. Right to Refuse Service

DFW Solar Services LLC reserves the right to refuse or discontinue service if:

  • Unsafe working conditions exist
  • The system poses safety risks
  • Work requested violates electrical or building codes
  • Payment terms are not met

17. Force Majeure

DFW Solar Services LLC shall not be liable for delays or failure to perform services due to circumstances beyond its reasonable control including but not limited to:

  • Weather events
  • Natural disasters
  • Utility outages
  • Supply chain disruptions
  • Labor shortages
  • Government restrictions

18. Governing Law

These Terms of Service shall be governed by and interpreted under the laws of the State of Texas.

Any disputes arising from services performed by DFW Solar Services LLC shall be resolved within the appropriate courts located in Texas.

19. Acceptance of Terms

By scheduling service, approving an estimate, or allowing technicians to begin work, the Client acknowledges and agrees to these Terms of Service.
